18、king. I didnt know, for example, that it could do terrible damage to your heart and lungs or that it was more difficult for smoking couples to become pregnant. I certainly didnt know their babies may have a smaller birth weight or even be abnormal in some way. Neither did I know that my cigarette sm
19、oke could affect the health of known-smokers. However, what I did know was that my girlfriend thought I smelt terrible. She said my breath and clothes smelt, and that the ends of my fingers were turning yellow. She told me that she wouldnt go out with me again unless I stopped! I also noticed that I
20、 became breathless quickly, and that I wasnt enjoying sport as much. When I was taken off the school football team because I was unfit, I knew it was time to quit smoking.I am sending you some advice I found on the Internet. It might help you to stop and strengthen your resolve. I do hope so because

32、公约)。本公约自以下当事人签署后即生效,该步行街的所有租户和非租户使用人均受本公约各条文的约束。租户更换,本公约继续有效。特别提示:本公约的签约单位为1. z市德兴实业发展有限公司( 以下简称“发展商” )2. (一般的社会承租者名称)( 以下简称为“租户” )3. z市z物业服务有限公司( 以下简称“管理者” )第一章 定 义在本公约,除文意另有所指需另行作解释外,用语所指意义如下:一.“该土地”:指根据z市国有土地使用权出让合同莞国地出合(1998)419号文及国有土地批准书,由z市国土局出让的位于中国z市z镇z路地块 约6万多平方米的土地使用权之土地。二. “该步行街”:指座落于该土地上
33、的z步行街或其任何部分。三. “公共地方” :指在该步行街内或该土地内由发展商根据本公约所指定的公共地方及按照本公约第三章第6条划为额外的公共地方。其中包括各入口大堂及通道、各扶手梯、直梯、楼梯间、人行道、行车道、卫生间、梯台、天台、绿化区及休息地方、管理者办事处及各监控室、电表房、锅炉房、电掣房、泵房、洒水系统泵房、消防及保安设备控制室、电话机房、消防泵房、光井、水箱、升降机房、发电机房、空调机房及为该土地及该步行街的租户及访客而设并供其共用的其他地方或范围,但不包括任何租户所承租的商铺内的地方及发展商保留之地方。四. “公共服务设施” :指为该步行街的公众利益而在步行街所属范围内安装的各种
34、设备、器械、装置,包括给、排水系统,中央空调及电力系统、通讯系统、消防系统、电子监控系统、保安系统、升降机、电梯、卫生间设备、照明系统、供电系统、供水系统、污水处理系统、共用去水道、共用沟渠、共用管道、槽沟、电线、电视、电缆、有线电视接收系统、绿化区之装置及种植物、告示板及其他机械、卫生设备。以上所列之各类设备不论是设置于公共地方、个别租户之商铺内或保留地方内,均属公共设施的一部份。但任何只供个别租户使用的设施不包括在内。五. “装修手册” :指发展商或管理者(如以下所定义)就各租户在其所属单元(如以下定义)的装修、更改、改进、加建及装饰等所作的规定。六. “用户手册” :指发展商或管理者根据
35、公约而制定及不时修订的供各租户使用其所拥有的单元及公共地方、公共设施、商铺及停车位时所需要遵守的细则。七. “绿化区” :指根据政府当局依照有关法令所要求或由发展商所设计规划在该土地上实施绿化的地区。八. “管理费预算” :指根据本公约和有关法规的规定而为该步行街预备的管理费预算。九. “管理费用” :指管理者因管理及保养该步行街而引起的所有费用和开支。十. “管理者” :指持有县级以上人民政府物业管理行政主管部门核发的物业管理资质证书,并向工商行政主管部门申请注册登记,领取营业执照,且根据发展商、租户委员会的聘请或委任管理z步行街(主体或部分)的公司。十一. “租户” :指对每个单元合法承租
36、或共同承租的人士,并包括其日后通过合法程序而成为当时的合法继承人。十二. “发展商” :指该步行街的发展商z市德兴实业发展有限公司。十三. “单元” :指在该步行街内商铺、车位或其它部分。十四. “商场”:指根据政府的批准文件规定作为购物用途的有关场所。十五. “车位” :指根据政府的批准文件规定作为停泊车辆用途的地方。十六. “本公约” :指上述当事人(即发展商、承租者与管理者)于上述日期签署的本公约,(如发展商及管理者乃同一法人,则有关公约只有发展商及租户签署),并包括补充协议、附署文件及一切有关管理该步行街的文件。十七. “交付使用通知书” :指发展商于该步行街可以交付给各租户使用时发给
37、各租户的通知书。十八. “摊分费” :指由该步行街在大项设施设备维修上的需要而作出的一次性支出,并当维修基金不足以支付或有关支出超过维修基金百分之五十之储备的情况下,管理者向各租户收取用以支付上述支出的金额。第二章 总 则一. 公共地方是为各租户的利益而设置的,可由租户及其雇员、访客及其他许可者使用。二. 各租户及其使用人均须遵守和履行本公约所载的保证、规定及限制,并受其约束。该等保证、规定及限制的保障和约束附带于该土地及该步行街的每个部分。三. 每个租户对其单元进行转租、批准享用或以其他方式处置,均需经该步行街管理者同意,且该处理须明确地受本公约限制和保障。若任何租户转租其单元给任何租客或租
38、户,须就该租客或租户适当履行及遵守本公约的条款向出租方及其他租户负责。另有其它约定,则应受该约定的约束。四. 本公约由开发建设单位或受其委托的物业管理单位报经物业管理主管部门审核批准,在办理进场手续时由租户签字,经百分之十五以上的已租用租户签字后即为生效。五. 租户之间、租户与物业管理公司之间因本公约发生的纠纷,协商不成的,提请市物业管理主管部门调解,或向当地人民法院提起诉讼。六. 本公约一式三份,发展商、租户、物业管理公司各执一份。第三章 发展商的权利下列权利将保留予发展商及其授权人:一. 发展商有权在其认为合适的情况下更改该步行街的名称或其中任何部分的名称及编号。在进行上述更改前,发展商应
39、提前三个月以书面通知所有租户,但无须就因此而引致的任何损失、费用或开支向各租户或其他拥有使用权的人赔偿。二. 发展商有权根据市场的需要,在其认为合适的情况下更改该步行街的经营范围。在进行上述更改前,发展商应提前三个月以书面通知所有租户,但无须就因此而引致的任何损失、费用或开支向各租户或其他拥有使用权的人赔偿。三. 发展商及其承建商、代理人及其他经许可的人为根据政府批准的图则、完成该物业的工程或需进行发展商对该步行街责任范围内的维修,包括但不限于公共地方及公共服务设施,有权携带一切必须的设备、机器及材料进入该步行街任何一部分,发展商必需预先通知(紧急情况除外)有关的租户或使用人。四. 发展商有权
40、对本公约签订时存在的该步行街建筑规划及蓝图进行更改、修订、增订或改动而无须任何其他租户或其他拥有该步行街权益的人同意或批准。但上述更改、修订、增订或改动须事先获得有关政府当局的批准。所有有关更改、修订、增订或改动并不赋予任何租户针对发展商诉讼的权利。唯上述更改、修订、增订或改动不得妨碍任何租户使用其单元的权利。五. 发展商有权于该步行街任何部分安装、架设、更改、保养以及拆去烟囱、招牌、广告、天线、桅杆、避雷针、照明及其他各种固定设施。并在事先给予各租户书面通知后(紧急情况除外)于一切合理时间内带同或不带同工人及设备进入该步行街任何部分,以便进行上述有关工程,或按发展商认为适当的条款准许或批准或
41、授权其他人进行上述工程。唯上述工程不得妨碍其他租户使用其所属的单元。六. 发展商有权将其于该步行街及该土地拥有所有权的部分在其认为适当的时间内划作额外的公共地方,并立约声明。在声明指定的时间内,该等额外地方构成公共地方的一部分,各租户须按其管理份额的比例负责该等额外地方的保养及维修。惟在行使上述权利时,发展商不得妨碍其他租户使用其所属单元。七. 发展商有权将在该步行街拥有所有权的任何部分转让或赠予,而无须其他租户同意,其他租户亦不得对之主张及/或要求包括但不限于优先购买权在内的任何权利。八. 发展商有权取消本章所规定由发展商指定的额外公共地方,而无需其他租户或其他对步行街享有利益人士的同意。九
42、. 发展商有权在其认为合适的情况下将管理份额分配或作出更改或重新安排,并有权以发展商的名义签署任何有关文件,而无须其他租户同意,但须以不改变各租户之间的管理份额比例为原则。十. 发展商有权向政府有关部门申请对土地批文作出发展商认为适当的修订、改动或修改,并就此事与政府磋商,达成协议,以发展商的名义签署任何有关文件,而无需其他任何租户同意或批准及无需联同其他业主签署任何有关文件。惟此项权利的行使不得妨碍其他租户使用其所属的单元及削减其现有之权益或增加其他租户任何负担(有益于该等租户且不违反政府规定者除外)。十一. 发展商有权扩大或重新划定该土地的界限,就此事与政府磋商及达成协议,而无须其他任何租
43、户同意或批准。十二. 在受本公约的限制和保障下,发展商有权转让、抵押、出租、批准占用、或以其他任何方式处置该步行街任何部分,而不须任何租户同意。十三. 发展商可委派代理人行使本公约保留予发展商的任何权利。十四. 发展商可按其认为适当的条件将本公约保留予发展商的全部或部分权利转让予发展商认为适当的人士或公司。十五. 发展商可就该步行街任何部分另行订立分契及其他有关管理该步行街的契约,唯该分契及契约不得抵触本公约的条款。十六. 发展商对本公约享有最终的解释权、修改权及/或废止权等。十七. 本公约所载发展商的其他权利。第四章 租户权利及责任一.租户的权利在各租户遵守本公约的所有规则、政府订立的有关法
44、例,并按期缴交有关费用的先决条件下,各租户将享有下述权利:(一) 依法享有在约定的租赁期限内对所承租物业的经营使用权。(二) 依法合理使用房屋建筑共用设施、共同部位和本物业内公用设施和公共场所(地)的权利。(三) 有权按有关规定进行室内装饰装修。(四) 有权根据房屋建筑共同部位、共用设施设备和所属物业管理范围的市政公用设施的状况,建议物业管理公司及时组织修缮。(五) 有权就物业管理的有关事项向物业管理公司提出质询,并得到答复。(六) 有权要求物业管理公司依照有关规定的期限定期公布物业管理收支帐目。(七) 有权对物业管理工作提出建议、意见和批评。(八) 有权向物业管理主管部门进行投诉或提出建议与
45、意见。(九) 有权要求商铺建设毗连部位的其他维修责任人承担维修养护责任,对方不维修养护或不予配合的,可要求物业管理公司强制责任方维修养护,并由责任方按规定分摊费用。二.租户有以下的责任:(一) 在使用、经营、转租所拥有的物业时,应遵守物业管理法规及有关政策规定。(二) 租户在转租其所拥有的物业时,应事先以书面通知管理者,并在得到管理者同意后才可转租。前租户亦有责任支付至转租日的管理费用及其他有关费用。(三) 各租户需按管理公司规定及时付清其所拥有物业的物业管理服务费、维修基金、水电费等费用。(四) 自觉维护公共场所的整洁、美观、畅通以及公用设施的完好。(五) 各租户如需进行室内装修装饰,必须遵守本物业装修装饰规定,并填写申请表,报物业管理公司审查及获书面批准后,向物业管理公司缴纳装饰装修押金后方可按规定施工,完工后由物业管理公司进行查验,如无违规、违章情况或妨碍他人正常使用物业的现象(如渗、漏、堵、冒等),押金予以退还,否则视违章情况对押金予以扣除并限期整改,如押金不足的,管理者亦有权向有关租户追讨;如属统一清运垃圾的,还应同时缴纳垃圾清运费;如有额外使用公用设施(如电梯、供电增容等)的,还应承担相应费用。(六) 租户如请物业管理公司对
