3、往极容易受到侵犯,得不到应有的保护。我国船员劳务派遣市场在管理方面仍存在多头管理的局面,社会保障体系尚不完善,监督体制也未建立起相应的长效机制。而国外的一些船员输出大国,如菲律宾、印度等都在船员外派方面有一套完善的管理培训体制,在船员劳务输出方面的立法也较我国健全和完善。因此,关注船员劳务派遣市场,关注其中所涉及的法律问题,对于我国发展外派产业、扩大外派规模是意义重大的。如果要提高我国外派船员的国际竞争力,对船员劳务派遣中存在的问题进行研究就更加显得迫切。本文以劳务派遣为着眼点,围绕船员劳务市场中船员输出过程中我国的政策、立法及权利保障等方面的问题,对船员劳务派遣所涉及的相关法律问题进行详尽的
4、分析探讨,希望我国的船员外派产业能在不断的发展壮大中,在扩大规模的同时,其中存在的问题也能得到更多的关注并最终予以解决,以促进船员劳务市场的健康发展。除引言和结论部分外,本文共分五章研究船员劳务派遣的相关法律问题。第一章分两个层面介绍了我国船员劳务派遣市场的概况。一个是我国船员劳务派遣市场的现状,主要介绍我国船员从走向国际劳务市场并发展壮大的情况;另一个是我国船员劳务派遣中存在的问题,包括船员对外劳务合作机制带来的问题、法律关系复杂带来的问题、航海培训教育方面的问题、船员外派管理机制方面的问题等。第二章针对劳务派遣这一用工方式的特殊性,阐述了船员劳务派遣法律制度的特点。这些特点具体体现在这几个
5、方面:根据我国的政策,对外输出船员必须采取对外劳务合作的方式,与一般的劳务派遣相比,有其自身特色;在船员教育培训方面,与其他船员相比,又有其特殊的要求;同时由于涉及船员、外派企业和国外船东三方,法律关系复杂;此外,船员服务机构在船员劳务派遣市场中也发挥着其特殊的作用。第三章分析了我国规范船员劳务派遣的相关法律法规,就这些法律法规从哪些方面调整船员劳务派遣分别予以了说明。第四章主要围绕船员劳务派遣中所涉及的相关权利展开,就我国外派船员的劳动保护、社会保障情况进行了分析,并对外派船员人身伤亡损害赔偿的有关问题如主体问题、赔偿范围进行了探讨。第五章解决了当事人之间的法律适用问题。外派船员、船员外派企
6、业和国外船东三方主体之间,在发生法律纠纷时,究竟如何适用法律,笔者均一一进行了详细的分析。例如如果外派船员对国外船东提起侵权损害赔偿诉讼,笔者在进行分析之后,主张适用船旗国法,这也是笔者在创新方面所做的努力。在最后的结论中,笔者认为,尽管船员劳务派遣中存在的问题纷繁复杂,但仍然是能够解决的。除了外派船员提高维权意识外,在制定统一规范的劳动合同范本、完善法律和社会保障体系等方面也可以做出努力,以促进船员外派产业的健康发展。此外我国的船员培训机构还应从扩大船员数量和提高船员质量两个方面着手,以提高我国外派船员的国际竞争力。关键词:船员,劳务派遣,船员服务机构8ABSTRACTSince China
7、s reform and opening up, Chinese seafarers gradually develop in the process of entering into the international labor market, they have become a sizable contingent and made great contributions to the development of the seafarers assignment industry. In China, however, enterprises must obtain business
8、 qualification of foreign labor service cooperation, then they are entitled to dispatch seafarers abroad, besides, there are many problems in the market of labor dispatch of seafarers because the laws and regulations with regard to labor dispatch of seafarers in China are not ideal. These problems a
9、re numerous and complicated, and negatively affect the healthy development of Chinas seafarers assignment industry. In the process of assignment and during the period of assignment, the legitimate rights and interests of seafarers dispatched abroad are quite easy to be infringed and lack proper prot
10、ection. It exists multiple management in the management of the market of labor dispatch of seafarers, social security system is not ideal yet, supervision system is not established and still lack relevant long-acting mechanism. While some strong foreign seafarers assignment countries, such as the Ph
11、ilippines, India, have a ideal system of management and training in the seafarers assignment as well as ideal legislation in the labor dispatch. Therefore, for the development of seafarers assignment industry and a larger scale in the labor dispatch of seafarers, it is significant to pay more attent
12、ion to Chinas market of labor dispatch of seafarers and the related legal problems. Thus, it is necessary to study on the legal problems of labor dispatch of seafarers so as to improve international competition capability of Chinese seafarers.The thesis emphasizes on the labor dispatch and surrounds
13、 the problems in the market of labor dispatch of seafarers in Chinas policy, legislation, guarantee of right, etc. Meanwhile, it fully analyzes and discuss relevant legal problems involved in the labor dispatch of seafarers, in the hope of more attention on these problems and these problems being se
14、ttled finally, and of promoting the healthy development in the process of developing and enlarging the scale.Besides the introduction and the conclusion, the thesis is totally divided into five chapters to study on the legal problems of labor dispatch of seafarers.Chapter one introduces general situ
15、ation in the Chinas market of labor dispatch of seafarers from two aspects. One is status quo of Chinas market of labor dispatch of seafarers, which mainly introduces the situation of Chinese seafarers entering into the international labor market and gradually developing; The other is the existed pr
16、oblems in labor dispatch of seafarers in China, including problems led by the labor service cooperation mechanism and complicated legal relationship and problems in navigation training and management mechanism of seafarers assignment, etc. Chapter two is mainly engaged in the characteristics of the
17、legal system of labor dispatch of seafarers on the basis of specific characteristics of labor dispatch, the above-mentioned characteristics includes: Compared with other labor dispatch, to output Chinese seafarers must adopt the method of labor service cooperation in accordance with Chinese policy;
18、Compared with other crew, there are special requests in the navigation training for seafarers dispatched abroad; Legal relationship is complicated because labor dispatch of seafarers involves seafarers dispatched abroad, enterprise dispatching seafarers abroad and foreign shipowner; Crew service age
19、ncies also play an important role in the market of labor dispatch of seafarers. Chapter three analyzes relevant laws and regulations which govern the labor dispatch of seafarers, to illustrate how these laws and regulations regulate the labor dispatch of seafarers. Chapter four is mainly engaged in
20、relevant rights involved in the labor dispatch of seafarers to analyze labor protection and social security of seafarers dispatched abroad and discusses relevant problems in the aspect of personal injury or loss of life of seafarers such as the main parts in the damage and the extent of the compensa
21、tion. Chapter five solves the problem of applicable law. Once disputes take place among seafarers dispatched abroad, enterprise dispatching seafarers abroad and foreign shipowner, how to apply law is an important problem, the author settled this problem on the basis of comprehensive analysis. For in
22、stance, the author advocates applying the law of the flag between seafarers dispatched abroad and foreign shipowner if the seafarers issues the foreign shipowner for infringement compensation for damages, which is the innovation of the thesis.
