1、DisciplinaryActionsandSanctionsforForeignStudentsAttendingXXUniversityofTechnologyXX理工大学留学生违纪处分规定PartIGeneralPolicies第一章总则1. InordertostrengthentheadministrationoftheInternationalEducationCollege(hereafterreferredastheCollege),maintainnormalacademicorderandlivingenvironment,buildacivilizedcampusande

2、ducatetheforeignstudentstoobservetheregulationsandabidebythelaw,XXUniversityofTCM(hereafterreferredastheUniversity)hasformulatedtheserulesandregulationsinaccordancewithXXUniversityofTCMPenaltiesforViolatingtheRulesandRegulationsandtheactualitiesoftheCollege.第一条为加强学院管理，维护正常的教学秩序和良好的学习、生活环境，建设文明校园，教育广

3、大留学生遵纪守法，在XX理工大学学生违纪处分暂行规定基础上，结合我院实际情况，制定本条例。2. Thesedisciplinaryactionsandsanctionsshallapplytothosewhoareofficiallyregistereddegree-seeking,ornon-degreeforeignstudentsandstudentsfromHongKong,TaiwanorMacaowhentheyarefoundtohaveviolatedtherulesandregulations.第二条本条例适用于XX理工大学具有正式学籍的留学生、港澳台学生及进修生。3. Th

4、eCollegeshalldealwiththosewhoviolatetherulesoftheUniversityontheprinciples:1) ofequity,fairnessandjustice,2) ofcombiningeducationwithpunishment,3) andofsafeguardingthestudents9rightofappeal.第三条违纪处分坚持公平、公开、公正原则；坚持教育与处分相结合原则；坚持学生的申诉权保障原则。4. Thesedisciplinaryactionsandsanctionsshallalsoapplytothosewhov

5、iolatetheruleswhenengaginginclinicalpracticeinhospitalsorothersocialactivitiesoffthecampus.第四条学生在校外参加临床实习、社会实践等社会活动中有违纪行为，参照本条例给予纪律处分。PartIITypesandApplicationofPenalties第二章处分种类和运用5. ThosewhoarefoundtohaveviolatedtherulesoftheUniversityshallbegiventhefollowingsanctionsdependingoncircumstanceslikethe

6、seriousnessofconduct,attitudetowardshisorheractandbehaviorofrepentanceetc.1) Disciplinarywarning-Awrittenstatementtothestudentthathis/herbehaviorisinviolationoftherules.Thestatementclarifiesexpectedfuturebehavior.Furthermisconductmaybetreatedwithmoreserioussanctions.ArecordoftheDisciplinarywarningsh

7、allbemaintainedinthedisciplinaryfiles.2) Demeritrecord-Itisanindicationthathis/herbehaviorisinseriousviolationoftherulesandfurtherviolationshallresultinmoreseveredisciplinaryaction,uptoandincludingDisciplinaryProbationorexpulsionfromtheUniversity.TheDemeritshallbepublishedonthecampusnoticeboardandsh

8、allbenotedintheStudenfstranscript.3) Disciplinaryprobation-Thissanctionisanofficialwarningthatthestudent,sconductisinviolationofUniversityregulationsorgovernmentlaws.Studentsplacedondisciplinaryprobationaredeemednotingoodstanding99withtheUniversity.Thedurationwillbeafullcalendaryearandadditionalstip

9、ulationsshallbeenforced.Additionalstipulationsshallbe,butarenotlimitedto,suspensionofrightsandprivileges,suspensionofeligibilitytoparticipateinscholarshiporanyotherawardofexcellenceselection,andnotationonthestudent,stranscript.Duringtheperiod,reportedviolationsoftheruleswillresultinExpulsion.Astuden

10、tmaypetitiontohavetheprobationliftedand/orthenotationremovedfromthetranscript.Thispetitionwillnotbeacceptableifsubmittedsoonerthanonecalendaryearfromthedatetheprobationbegan.Disciplinaryprobationshallnotbeapplicabletothosewhohaveonlyoneyeartograduate.4) Expulsion-Thisresultinpermanentterminationofst

11、udentstatuswithoutpossibilityofreadmission.PermanentnotationofthisactionshallberecordedonthetranscriptandthestudentisbarredfromtheUniversity.Therearesupplementarysanctionswhicharedescribedasfollows:5) Compensationforlosses;6) Fine;7) Confiscationofprohibitedarticles.Supplementarysanctionsmaybeimpose

12、dindependently.第五条学生违反校纪校规，视情节轻重，认错态度，悔改表现等，给予下列之一的处分：一、警告二、记过三、留校察看四、开除学籍除以上纪律处罚外，附加处罚如下：第2页共10页五、赔偿损失六、罚款七、没收违禁物品附加处罚也可以独立适用。6. Sanctionsforactsviolatingtherulesshallbemitigatedunderanyofthefollowingcircumstances:1) whenthoseresponsiblevoluntarilyadmittheirmistakes9havebehaviorsofrepentanceandcorr

13、ectthemintime;2) whenthoseresponsiblewerecoercedorinducedbyothersandthenvoluntarilyassisttheCollegetoinvestigatetheincident;3) orwhenthecircumstancesareobviouslyminorandtheharmdoneisnotserious.第六条违纪者有下列情形之一者，应当减轻处分。1)、能主动承认错误，如实交待错误事实，检查认识深刻，有悔改表现者；2)、确系他人胁迫或诱骗，并能主动协助学校有关部门弄清事实真相、认错态度较好者；3)、其他根据违纪情节

14、违纪后果等可从轻处分者。7. Heavierpenaltiesshallbegivenforactsviolatingtherulesunderanyofthefollowingcircumstances:1) Whenthoseresponsiblerefusetoadmitmistakeandshowabadattitudetowardsthemanagement;2) Whenthoseresponsiblehavebeenrepeatedlypunishedandrefusetoamend.3) Whenthoseresponsibletakerevengeontheinforman

15、tsorwitnesses;4) WhenthoseresponsiblecommittheactagainstdisciplinegangingtogetherwithpeopleoutsidetheUniversity;5) Whenthoseresponsibleactasaheadduringthegroupviolation;6) whenthoseresponsiblehavealreadyreceiveddisciplinarywarningordemeritrecordonceandthencommitanactagainstdisciplineagain;Expulsions

16、hallbeimposedonthosewhohavealreadyreceiveddemeritrecordtwiceduringhisorherstayintheUniversityandthencommitviolationagain;7) WhenactshavecausedrelativelyseriousconsequencesorincurredadverseeffectontheUniversity;8) Anyonewhoreceivesdisciplinarysanctionshallbegivensuchadditionalpunishments:(a) Thosewho

17、receiveWarning,DemeritRecordorDisciplinaryProbationshallbecancelledthequalificationforscholarshipinthegivenacademicyear.(b) ThosewhoreceiveDisciplinaryProbationmaybeliftedsanctionafteroneyeariftheybehavewellandnofurtherinfractionsoftheuniversityrulesandregulationsarecommitted.Ifnot,theyshallbeexpell

18、edfromtheuniversity.第七条违纪者有下列情形之一者，应当加重处分：1、违纪后拒不承认错误，态度恶劣者；2、屡犯不改者；3、对检举人、证人等有关人员打击报复、威胁恫吓者；4、伙同校外人员作案者；5、群体违纪为首者；6、曾受过一次警告或记过处分者，第二次违纪时从重处分；在本校累计受两次记过以上处分者，第三次违纪时，无论情节轻重，一律给予开除学籍处分；7、违纪行为造成的后果严重，或给学校造成恶劣影响者；8、受处分者，附加给予以下处罚：(1)受警告、记过至留校察看处分者，一学年内不得参与评定奖学金；(2)留校察看以一年为期，受留校察看处分者，在留校察看期内有显著进步表现的，可按期解除

19、留校察看；经教育不改的可开除学籍。PartIIIActsViolatingtheRulesandSanctions第三章违纪行为和处分8. Whoevercommitstheactsdisturbingpublicandacademicorderordisruptingthestabilitybyorganizingandincitingdisturbance,ifseriousconsequenceincurred,shallbeexpelledfromtheUniversity.第八条组织和煽动闹事，扰乱学校和社会秩序，破坏安定团结，造成严重后果者，给予开除学籍处分。9. Whoeverv

20、iolatesChineselawsandregulationsandispunishedbythePublicSecurityorgansorjudicialorgansshallalsobegiventhedisciplinarypenaltiesfromtheUniversityasfollows:(I)ExpulsionfromtheUniversityshallbegiventothosewhoaresentencedtopublicsurveillance,criminaldetentionorreeducationthroughlabor;(2) Demeritrecord,di

21、sciplinaryprobationorexpulsionfromtheUniversityshallbegiventothosewhoaredetaineddependingoncircumstances;(3) SeriouswarningordemeritrecordshallbegiventothosewhoarewarnedorfinedbythePublicSecurityorgansdependingoncircumstances.第九条违犯国家法律、法令、法规，受到公安、司法部门处罚者：1、被判处管制、拘役、劳动教养或有期徒刑以上处罚者，给予开除学籍处分；2、被处以治安拘留者

22、视情节轻重，分别给予记过、留校察看或开除学籍处分；3、被处以治安警告或治安罚款者，视情节轻重，给予严重警告或记过处分10. WhoeverstealsordefraudsmoneyorpropertyandispunishedbythePublicSecurityorgansor第4页共10页judicialorgansshallalsobegivenadisciplinaryactionfromtheuniversityaswellaspayingbackthestolenmoneyandgoodsinfull.Andforthosewhocommitthefollowingactslik

23、e:(1) Stealinganofficialseal,confidentialdocumentsorfilesshallbegivenDisciplinaryprobationandabove(2) Standingsentry,providinginformationortoolsforatheft,deliberatelyconcealingofatheft,orholding,handlingorsharingofanystolengoodsshallbegivenDemeritrecordandabove;(3) Stealingother,sIDtogetmoneyorprope

24、rtyillegallyshallbegivenDemeritrecordandaboveinadditiontopayingbackthemoneyandproperty;(4) Stealingother,sinternetaccountandconsequentlycausinglosstotheothershallbegivenWarningandaboveinadditiontocompensationfortheloss;(5) ForgingasealforanillegalactivityshallbegivenDisciplinaryprobationandabove;(6)

25、 CausingseriouseconomicandsocialdamagebytheiroffenceshallbegivenExpulsionfromtheUniversity(7) Stealingordefacinglibrarypublicationsshallbegivenpenaltyaccordingtothelossincurred第十条对偷窃、诈骗他人财物者，除如数偿还赃款、赃物和按公安机关有关规定进行处罚外，学校视情节轻重分别给予警告、记过、留校察看、开除学籍处分。另有下列情况的，视情况给予处分：(一)偷窃公章、保密文件、档案等物品者，视其情节和后果轻重，给予留校察看以上

26、处分；(二)为盗窃者放哨、提供信息和作案工具，或知情不报，或参与窝赃、销赃、分赃者，给予记过以上处分；(三)盗用他人证件冒领他人钱物者，除追回冒领的钱物外，视情节轻重及作案金额给予记过以上处分；(四)盗用他人互联网帐户，给他人造成损失者，除赔偿所造成的损失外，给予警告以上处分；(五)私刻他人印章，或非法伪造公章作案者，给予留校察看以上处分；(六)作案行为造成重大经济损失和社会危害者，给予开除学籍处分；(七)盗窃、损毁公用书刊者，视价值金额进行处理；11. Anyonewhodeliberatelydamagespublicfacilitiesshallbegivenpenaltyranging

27、fromWarningtoDisciplinaryProbationaccordingthelossincurred.第十一条故意损坏公物，除赔偿损失外，将视损坏公物价值给予警告、记过或留校察看处分。12. Forthosewhoareinvolvedinafighting:（1） Anyonewhodoesn,tengageinafightingthough,butservestofantheflamesofthefightingshallbegivenWarning（2） Anyonewhoinstigatesafightingandcausesaconsequenceshallbegiv

28、enDemeritRecord;Ifseriousconsequenceincurred,thepenaltyshallbeDisciplinaryProbationorExpulsion;（3） Fortheactoffighting: Anyonewhofights,causingnoinjury,shallbegivenWarning;第5页共10页 Anyonewhofights,causingaminorinjury,shallbegivenDemeritRecordorDisciplinaryProbation; Anyonewhofights,causingasevereorev

29、encripplinginjury,shallbegivenExpulsion; AnyonewhofightswithaweaponshallbegivenDisciplinaryProbationorExpulsion;（4） Anyonewhoprovidesweaponforafighting: ShallbegivenDemeritRecordorDisciplinaryProbationifthecaseisofnogreatconsequence; ShallbegivenExpulsionifthecaseisofgreatconsequence.（5） Foranyonewh

30、otriestoretaliateagainstotherpeopleafterthefighting,thepenaltyshallbeincreasedorevenExpulsionshallbeimposed.（6） Foranyonewhotriestoarrangeotherpeopletowillfullytellanuntruthintheirfavorafterthefighting,thepenaltyshallbeincreased.（7） Anyonewhofightsandcausesaninjuryshallpayforthemedicaltreatment,nutr

31、itionfeesandcompensationforallthepropertylossincurredinadditiontothedisciplinarypenalty.Forthosewhofailtopayallthecompensationintime,thepenaltyshallbeincreasedtoagreaterlevel.第十二条肇事、策划或参与打架斗殴，为打架斗殴提供凶器者：（一）虽未动手，但在打架中起哄者，给予警告处分；（二）唆使他人打架斗殴，并造成后果者，给予记过处分；后果严重者，给予留校察看或开除学籍处分；（三）打架斗殴者：1、动手打人未伤他人者，给予警告处分

32、2、致他人轻伤者，给予记过或留校察看处分；3、致他人重伤或致残者，给予开除学籍处分；4、持械打人者，视后果程度，给予留校察看或开除学籍处分；（四）、为他人打架斗殴提供凶器者：1、未造成严重后果，给予记过处分或留校察看处分；2、造成严重后果者，给予开除学籍处分；（五）打架事件终止后，对他人进行报复者，加重处分直至开除学籍；（六）在处理打架事件过程中，利用不正当手段组织他人提供伪证者，加重处分；（七）打人致伤者，除按上述给予纪律处分外，均需赔偿受害者的医药费、营养费及损坏的公私财物等一切必要费用，如不按期交纳赔偿费，给予加重一级处分。13. Anyonewhorejectsordosomethi

33、ngtohinderthemanagementtoinspectdormitoryshallbegivenawarning.Studentswhoabuseorevenassaultthemanagementshallbegivenseriouswarningorevenaheavierpenalty.第十三条拒绝、妨碍学校管理人员依照校规校纪执行公务者，视其情节轻重给予警告以上处分。寻第6页共10页衅滋事、侮辱、漫骂、威胁、恐吓或殴打教职员工者，视情节轻重给予留校察看以上处分。14. Suchactsasdefamingothers,committingperjury,forgingorta

34、mperingwithanydocumentsshallbegivendisciplinarysanction.(1) AnyonewhofabricatesarumoragainstothersandcausesadverseeffectshallbegivenDemeritRecord(2) AnyonewhocommitsperjuryandconsequentlycausestroublefortheinvestigationshallbegivenDemeritRecord(3) Anyonewhoforgesortamperswithanyimportantdocumentshal

35、lbegivenDisciplinaryProbationorExpulsion(4) Anyonewhohides,discards,damagesorillegallyopensotherpeople,slettersorparcelsshallbegivenDemeritRecordandbearsalltheresponsibilityincurredaswell.第十四条凡诽谤诬蔑他人，有提供伪证、伪造或涂改证件等行为者，分别给予下列处分：(一)捏造事实、诬蔑他人造成不良后果者，给予记过处分；(二)提供伪证，给调查造成困难者，给予记过处分；(三)伪造、涂改证件或重要材料，给予留校察看

36、或开除学籍处分；(四)隐匿、毁弃或私拆他人邮件包裹者，给予记过以上处分，同时负责由此而引起的一切后果。15. Anyonewhoisfoundwatching,collectingorcirculatingunhealthyvideoorreadingunhealthyorvulgarbooksshallbegivenWarningorDemeritRecord.第十五条观看、收藏、传播不健康或低级庸俗的书刊及音像制品、物品者给予警告或记过处分；16. Anyboywhostaysthewholenightatgirls,hostelorviceversashallbegivenDiscipl

37、inaryProbationorExpulsion.Andanyboyorgirlwhoallowsthestayshallbegiventhesamedisciplinarysanction.第十六条在异性宿舍留宿或留宿异性者，给予留校察看或开除学籍处分；17. AnyonewhoisfounddrugtakingshallbegivenExpulsion第十七条有吸毒行为者，一经发现，给予开除学籍处分。18. Anyonewhoengagesinanyillegalorganizationoractivitywithoutapprovalfromthemanagement(1) Shall

38、begivenaPublicReprimandorWarningifthecaseisnotseriousandtheoffenderamendstheirerrorsafteradmonition;(2) ShallbegivenDemeritRecordifthecaseisseriousandrefusetoamendtheirerrors.第十八条未经学校批准，策划或参与非法组织活动者：(一)情节较轻，经教育后改正者，给予通报批评或警告处分；(二)情节严重，经教育坚持不改者，视情况给予记过以上处分。19. Anyonewhodrinksexcessivelyandmakestroubl

39、eshallbegivenDemeritRecordormoreseriouspenaltyaccordingtocircumstances.第十九条酒后肇事者，视情节轻重，给予记过以上处分。20. AnyonewhorentsaflatoutsidewithoutpriorapprovalandneglectadvicetocorrectshallbegivenDisciplinaryProbation.第二十条擅自在校外租房居住，经劝阻无效者，给予留校察看处分。21. Anyonewhoswimsinriver,lakeorreservoirwithoutpriorapprovalfrom

40、themanagementshallbegivenDisciplinaryProbation第二十一条擅自到江、河、湖泊、水库游泳者，给予留校察看处分。22. AnyonewholeavesthecityofXXortheplacewhereheorshedoestheinternshipwithoutpriorapprovalduringtheirstayinChina,shallbegivenDemeritRecordifthecaseisnotseriousandtheviolatorshowswillingnesstoamendaswell;orshallbegivenDiscipli

41、naryProbationifthecaseisseriousortheviolatorrefusestoamend.第二十二条在校(或实习)期间，未经批准，擅自离校或离开实习单位回家，或外出XX(实习单位所在市、县)者，情节轻微，认错态度好者，给予记过处分；情节严重或认错态度不好者，给予留校察看处分。23. AnyonewhostaysoutofthecampusatnightandfailstoreturntothedormitorybeforethetimeasrequiredshallbegivenDemeritRecord.第二十三条在校学生到校外夜宿不归者，给予记过处分。24. A

42、nyonewhosetsofffirecrackersorfireworksinthecampuswithoutpriorapprovalfromthemanagementshallbegivenWarning.Ifanylossincurred,punishmentshallbeincreasedinadditiontomakingcompensation.第二十四条未经学校许可，随意在校园内燃放烟花、鞭炮者，给予警告处分。造成后果者，除追究其经济责任外，还要视情节加重处分；25. Forthosewhoviolatetherulesandregulationsforclassroom,do

43、rmitory,canteenandlibraryasfollows:(1) AnyonewhoviolatestherulesforpoweruseinthedormitoryshallbegivenWarning.Ifanylossincurred,punishmentshallbeincreasedinadditiontomakingcompensation.(2) Anyonewhomakessucharacketinpublicorholdscelebrationtillmidnightastoimpairotherpeople,sdailylife,workorstudy,andr

44、efusestocorrecttheirerrorsinspiteofadmonitionsshallbegivenWarning.(3) AnyonewhodropslitterorsewageinthecampusandrefusestocorrectdespiteadmonitionsshallbegivenWarning.Andifseriousconsequenceincurred,penaltyshallbeincreased.(4) Anyonewhocausesequipmentdamages,injuriesorevendeathsduetomishandlingorviol

45、ationoflabordisciplinesshallbegivenpenaltyinaccordancewiththeseriousnessofthecasesinadditiontocompensationfortheloss.第二十五条对违反教室、宿舍、食堂、图书馆等公共场所纪律者，视情节轻重给予下列处分：第8页共10页（一）违反宿舍安全用电管理规定者，给予警告处分；造成后果者，除追究其经济责任外，还要视情节加重处分；（二）在公共场所大声喧哗或在宿舍内举办庆祝活动至深夜,干扰或影响他人学习、工作和休息，经批评教育不改者给予警告处分；（三）乱倒污水、垃圾等杂物，影响校内环境卫生，经教育不

46、改者，给予警告处分；造成严重后果者，加重处分；（四）在学习、实验中违反操作规程或违反劳动纪律造成人身伤亡、设备损失事故者，视情节轻重，给予警告直至开除学籍处分，并视情节赔偿损失。26. AnyonewhofailstocompletetheirtaskasrequiredfornoorproperreasonduringinternshipshallbegivenWarningormoreseriouspenalty.第二十六条凡在实习期间，无故或非正当理由，不按实习计划完成任务者，给予警告以上处分。27. Anyonewhoseaccumulatedabsenteeismcomestoasf

47、ollows:（1） 12%ofthetotalclasshoursshallbegivenaPublicReprimand（2） 12%-25%shallbegivenWarning（3） 25%-38%shallbegivenDemeritRecord（4） 38%-50%shallbegivenDisciplinaryProbation（5） 50%andaboveshallbegivenExpulsion第二十七条一学期内旷课累积占总学时比率达到下列者：（一）12%以下者，给予通报批评；（二）12%-25%者，给予警告处分；（三）25%-38%者，给予记过处分；（四）；38%-50%者

48、给予留校察看处分（五）50%以上者，给予开除学籍处分28. PunishmentMeasuresforViolationsofRegulationsinexams:（1） AnyonewhoviolatesexamrulesandregulationsshallbegivenDemeritRecord;（2） AnyonewhocheatsinexamsshallbegivenDisciplinaryProbation;（3） AnyonewhocheatstwiceshallbegivenExpulsion（4） Anyonewhositsforexamasaringerorhiresaringertositanexaminhis/hernameshallbegivenExpulsion.第二十八条考试违纪、作弊者：（一）违犯考场纪律者，给予记过处分；（二）考试作弊者，给予留校察看处分；（三）考试作弊累计两次者，给予开除学籍处分；（四）替人代考或请人代考者，给予开除学籍处分。29. Foranyoffencewhichisnotmentionedhere
